I. Acceptance of Terms
By creating an account or using TheArtSoko platform in any way, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are using the platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
We may update these Terms from time to time. Continued use of the platform after changes constitutes your acceptance of the revised Terms.
II. Use of Platform
Browse & Discover
You may browse artworks, explore artist profiles, and engage with the community freely as a registered user of TheArtSoko.
Transactions
All purchases made through our platform are subject to our Buyer Protection Policy. Prices are listed in USD unless otherwise stated.
TheArtSoko grants you a limited, non-exclusive, non-transferable licence to access and use the platform for personal, non-commercial purposes in accordance with these Terms. Any use of the platform beyond what is expressly permitted requires our prior written consent.
III. Accounts
Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account.
Accurate Information
You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date at all times.
One Account Per User
Each user may maintain only one active account. Creating multiple accounts to circumvent restrictions or bans is prohibited.
IV. Buying & Selling
Artists listing works on TheArtSoko agree to accurately represent their artworks, including medium, dimensions, condition, and authenticity. TheArtSoko charges a commission on each completed sale, as outlined in the Artist Handbook. Buyers are responsible for reviewing all artwork details before completing a purchase. All sales are final unless the artwork arrives damaged or materially differs from its listing.
V. Intellectual Property
By listing an artwork on TheArtSoko, you grant us a non-exclusive, royalty-free licence to display, reproduce, and promote your artwork solely for the purpose of operating and marketing the platform. This licence ends when you remove your listing.
All platform content — including logos, design, code, and copy — is owned by TheArtSoko, Inc. and protected by applicable intellectual property laws. You may not copy, modify, or distribute any platform content without our express written permission.
VI. Prohibited Conduct
You agree not to:
Post counterfeit, stolen, or misrepresented artworks
Harass, threaten, or abuse other users or artists
Attempt to circumvent fees by transacting outside the platform
Use automated tools to scrape or crawl the platform
Upload malicious code or interfere with platform security
Impersonate any person or entity on the platform
VII. Disclaimers
“TheArtSoko is provided on an “as is” and “as available” basis without warranties of any kind.”
We do not warrant that the platform will be uninterrupted, error-free, or free of viruses. We make no representations about the accuracy, completeness, or authenticity of any artwork listing. Buyers are encouraged to conduct their own due diligence before making a purchase.
VIII. Limitation of Liability
To the fullest extent permitted by law, TheArtSoko shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your access to or use of the platform, even if we have been advised of the possibility of such damages.
IX. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, the platform, or third parties. Upon termination, your right to use the platform will immediately cease. You may also delete your account at any time through your account settings.
